Terms of Use
Effective October 6, 2026
Estero counts days from the records on your phone and shows how the rules it knows would apply. It is a planning tool, not legal, immigration or tax advice. Always confirm with the authority before you rely on a date.
1. These terms
These terms are an agreement between you and Majd Nassif ("we") for the use of the Estero app and this website. They apply together with Apple's Licensed Application End User License Agreement. Where the two differ, these terms apply to the extent the law allows. By using Estero you accept them.
2. Not legal, immigration or tax advice
Estero tells you how many days you have spent in places, and how rules such as the Schengen 90/180 limit, residence permit absence limits, 183-day tests and the US substantial presence test would apply to those days. Please keep in mind:
- Rules change, have exceptions, and are applied by officials who may count differently. The rules in Estero are simplified summaries and may be out of date or incomplete for your situation.
- Estero's counts are only as accurate as its records. Location can be missed, photos can carry wrong dates or places, and entries can be marked late or incorrectly.
- Tax residence depends on more than days, including ties, treaties and elections. Immigration status depends on your full history and the decisions of the authorities.
Do not rely on Estero alone for decisions about travel, immigration or tax. Confirm with the relevant authority or a qualified adviser. We are not responsible for refused entry, overstays, lapsed status, fines, taxes or any other consequence of decisions made using Estero.
3. Your information
You are responsible for the accuracy of what you enter, and for having permission to record the details of anyone you add under Family. How Estero handles information is set out in the Privacy Policy.
4. Subscriptions
Estero is free to use, with optional subscriptions to Estero Pro and Estero Family sold through the App Store.
- Payment is charged to your Apple Account when you confirm the purchase.
- Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
- A free trial, where offered, becomes a paid subscription when it ends unless cancelled at least 24 hours before. Any unused part of a trial is forfeited when you buy a subscription.
- You can manage or cancel a subscription in your Apple Account settings. Cancelling stops the next renewal; you keep access until the end of the period already paid.
- Refunds are handled by Apple under its policies. We cannot issue refunds for App Store purchases.
- Prices may change. A change will not affect a period already paid, and Apple will tell you before a higher price applies to a renewal.
Features available on each plan are described in the app and on this website, and may develop over time. Every warning that keeps you within the rules stays available on the free plan.
5. Acceptable use
Use Estero only lawfully and for your own records and those of people who have agreed to be added. Do not copy, modify, reverse engineer or redistribute the app, except as the law allows.
6. Ownership
Estero, its design, text and rule data are owned by us or our licensors. Your records belong to you.
7. Availability and changes
We work to keep Estero accurate and available, but we do not promise that it will be free of errors or interruptions, or that every rule or country is covered. We may update, change or withdraw features, and we may update these terms. The effective date above shows the latest version; continuing to use Estero after a change means you accept it.
8. Disclaimer
Estero is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy and non-infringement.
9. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for losses arising from reliance on Estero's counts or rule summaries. Our total liability for any claim relating to Estero is limited to the amount you paid for Estero in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
10. Ending
You can stop using Estero at any time by deleting it. We may end your access if you seriously breach these terms. Sections 2, 6, 8, 9 and 11 continue after that.
11. Law
These terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts.
